The Companies Act, 2013 stipulates that companies with a net worth of ₹500 crore or an income of ₹1,000 crore or a net income of ₹5 crore need to spend 2% of their average profits over the past 3 years on
Social Development related Activities.
CSR rules give companies the opportunity to realizing such services through a registered trust or society, with a with at least 3 years’ experience in the area, a foundation established by the company (foundations are a Section 25 companies) or subsidiary/ associate companies. Many companies adopt a mixed model of CSR, whereas partial projects are executed through Non-Profits, and the remaining ones they implement though their company formed and controlled foundation or trusts.
In some areas, these foundations have the required expertise, and in others they don’t. In areas where the foundations or the corporates don’t have expertise, they prefer better to work with NGOs (non-governmental organizations). This is also true when they go beyond their existing boundaries to the new geographical locations. Apart from expertise & time allocation is another big factor, why most of the companies on the list are still doing their CSR by donating money to NGOs.
